These Terms of Service (“Terms”) govern your access to and use of OminiSight (the “Service”), operated by AppOn Software Private Limited (“AppOn”, “we”, “us”), available at https://ominisight.net. By signing in to the Service you agree to be bound by these Terms.
1. Eligibility and account access
- OminiSight is an invite-only internal tool. You may only use the Service if (a) you are an employee or contractor of AppOn, or (b) you are a representative of a studio that AppOn has partnered with, and in either case an authorised AppOn administrator has provisioned an account for you.
- You must be at least 18 years old.
- You are responsible for keeping your password and any connected Google account credentials confidential. You must notify swaroop@appon.co.in immediately if you suspect unauthorised access.
- Each account is for an individual. Sharing accounts is prohibited.
2. The Service
OminiSight provides:
- A consolidated view of revenue and analytics from Google Ads, AdMob, Google Play, Firebase / GA4 and BigQuery.
- An advisory marketing-intelligence layer that surfaces insights drawn from the connected accounts.
- Internal operations features (timeline, tasks, leaves, notifications, messaging) and integrations with self-hosted collaboration tools.
We may modify, suspend or discontinue features at any time. We will give reasonable notice for material changes that affect administrators.
3. Connected Google services
- You or your administrator may connect Google services (Google Ads, AdMob, Google Play Developer, Google Drive, Firebase / GA4, BigQuery) using OAuth 2.0 or service-account credentials.
- You represent that you have the authority to grant OminiSight access to each connected account, and that doing so does not breach any contract or policy.
- You may revoke access at any time from within OminiSight or from your Google account settings.
- Your use of any Google product remains subject to Google’s own terms and policies. We do not control or modify Google services.
4. Acceptable use
You agree that you will not:
- Use the Service for any purpose other than the legitimate internal business of AppOn or its partner studios.
- Connect Google accounts you do not have authority to connect, or use OminiSight to access data you are not authorised to view.
- Attempt to bypass authentication, permission checks, rate limits or security controls.
- Scrape, probe or reverse engineer the Service except where allowed by mandatory law.
- Upload malware, attempt to inject code, or interfere with other users.
- Export or distribute Google user data obtained through the Service in a manner that violates the Google API Services User Data Policy, including its Limited Use requirements.
- Use the Service to send unsolicited communications, or to violate any applicable law.
5. Data ownership
- Data belonging to AppOn or to a partner studio remains the property of that party. Granting OminiSight access does not transfer ownership.
- OminiSight itself, including its source code, design and documentation, is owned by AppOn Software Private Limited. These Terms grant you a limited, non-transferable, revocable right to use the Service while your account is active.
- Aggregate, anonymised statistics about Service usage (for example, “number of API calls made this month”) may be used internally by AppOn to operate and improve the Service.
6. Privacy
Our Privacy Policy describes what information OminiSight collects, how it is used and how it is protected. By using the Service you acknowledge and agree to the practices described there.
7. Confidentiality
Information you access through OminiSight — including revenue figures, analytics data, partner identities and unreleased product information — is confidential. You agree not to disclose it to anyone outside the authorised group of users, except where you have an explicit business reason and the necessary permissions.
8. Service availability
We aim to keep OminiSight available, but we do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, third-party outages (for example, Google API outages), or factors outside our control. We are not liable for any such interruptions.
9. Disclaimer of warranties
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, AppOn disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be error-free or that the data shown is complete or accurate — you are responsible for verifying any figure that drives a business decision.
10. Limitation of liability
To the maximum extent permitted by applicable law, AppOn will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of the Service. Our total liability in connection with the Service will not exceed the greater of (a) the amount you (or your organisation) paid to AppOn for use of the Service in the 12 months before the event, or (b) INR 10,000.
11. Indemnity
You agree to indemnify and hold harmless AppOn from any claim, loss or expense arising from your breach of these Terms, your misuse of the Service or your violation of any applicable law or third-party right (including Google’s policies).
12. Suspension and termination
- An AppOn administrator may suspend or terminate your access at any time, with or without cause.
- We may terminate or suspend the Service, in whole or in part, if we believe doing so is necessary to comply with law, to protect users, or to avoid harm to AppOn.
- You may stop using the Service at any time. Sections that by their nature should survive termination (including confidentiality, disclaimers, limitation of liability and governing law) will continue to apply.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. If the changes are material we will also notify administrators by email or in-app message before the changes take effect. Your continued use of the Service after a change indicates acceptance of the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Madhya Pradesh, India.
